A quotation becomes a binding contract upon written acceptance by the client and receipt of any required deposit. Acceptance may be via signed proposal, email confirmation, or commencement of work.
3.3 Scope of Work
Quotations are based on information provided at the time of estimation. Any changes to project scope, specifications, or site conditions may result in additional charges.
4. PAYMENT TERMS
4.1 Payment Schedule
Unless otherwise agreed in writing, payment terms are:
- Deposit: 30% upon acceptance of quotation
- Progress Payments: As specified in contract (typically at key milestones)
- Final Payment: Due within 7 days of practical completion
4.2 Late Payment
Late payments may incur interest at the rate of 2% per month. We reserve the right to suspend work until overdue payments are received.
4.3 Payment Methods
We accept bank transfer, cheque, and credit card (service fees may apply).
5. PROJECT TIMELINE AND DELAYS
5.1 Estimated Timeframes
Project timelines are estimates based on normal working conditions. Actual completion dates may vary due to factors beyond our control.
5.2 Delays
We are not liable for delays caused by:
- Adverse weather conditions
- Client-requested changes or variations
- Delays by other trades or contractors
- Material supply shortages
- Site access restrictions
- Force majeure events
6. CLIENT RESPONSIBILITIES
The client agrees to:
- Provide accurate project information and specifications
- Ensure site access during agreed working hours
- Provide suitable storage areas for materials and equipment
- Ensure power and water supply are available
- Coordinate with other trades to avoid conflicts
- Obtain all necessary permits and approvals
- Make timely decisions on variations and selections
7. VARIATIONS AND CHANGES
All variations to the agreed scope of work must be confirmed in writing. Variation costs will be calculated based on current rates and added to the contract sum. Work on variations may not commence until written approval is received.
8. WARRANTIES AND GUARANTEES
8.1 Workmanship Warranty
We warrant that all work will be performed in a professional and workmanlike manner in accordance with industry standards and applicable building codes. Defects in workmanship will be rectified at no charge for a period of 12 months from practical completion.
8.2 Material Warranties
Materials are covered by manufacturer warranties. We will assist in warranty claims but are not responsible for material defects beyond our control.
8.3 Exclusions
Warranties do not cover:
- Damage caused by client or third parties
- Normal wear and tear
- Improper maintenance or cleaning
- Changes to building structure or environmental conditions
- Damage from water ingress or moisture (unless caused by our work)
9. LIABILITY AND INDEMNITY
9.1 Limitation of Liability
Our liability is limited to the contract value of the specific project. We are not liable for indirect, consequential, or incidental damages including loss of profits, business interruption, or third-party claims.
9.2 Insurance
We maintain appropriate public liability insurance and workers compensation insurance as required by Australian law.
9.3 Client Indemnity
Client agrees to indemnify V LAND PLASTERING against claims arising from inaccurate information provided, site conditions not disclosed, or client's failure to obtain necessary permits.
10. TERMINATION
10.1 Termination by Client
Client may terminate the contract with 7 days written notice. Client will be liable for all work completed, materials ordered, and reasonable cancellation fees.
10.2 Termination by V LAND
We may terminate the contract if:
- Client fails to make payment within 14 days of due date
- Client breaches these Terms
- Site conditions make work unsafe or impossible
- Client becomes insolvent
11. INTELLECTUAL PROPERTY
All content on this website, including images, logos, text, and project photos, is the property of V LAND PLASTERING and protected by copyright. Unauthorized use is prohibited.
12. PHOTOGRAPHY AND MARKETING
We reserve the right to photograph completed projects for portfolio and marketing purposes unless client expressly objects in writing.
13. DISPUTE RESOLUTION
Any disputes will be resolved through:
- Good faith negotiation between parties
- Mediation (if negotiation fails)
- Arbitration or legal action as a last resort
14. GOVERNING LAW
These Terms are governed by the laws of Victoria, Australia. Both parties submit to the exclusive jurisdiction of the courts of Victoria.
15. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16. AMENDMENTS
